Burkina Faso’s Judicial System Revamped to Align with National Realities

Ouagadougou: The deputies of the Transitional Legislative Assembly (ALT) examined and unanimously adopted yesterday Monday, the law on the organization of the judiciary in Burkina Faso with a view to bringing the judicial system into line with national realities and expectations.According to Burkina Information Agency, this law, which is a rereading of law n°015-2019/AN of May 2, 2019, introduces innovations on provisions common to all jurisdictions, the procedure before the court of appeal, the procedure before the high courts, and the treatment of difficulties of execution. Notably, the new law allows for the establishment of criminal and juvenile chambers within the Court of Appeal and permits single-judge sittings for certain specific cases.A significant amendment under the new law is the authorization for all courts to conduct hearings in a national language, provided that the parties consent. This change aims to make the judicial process more inclusive and accessible. Additionally, juvenile judges will now hear offenses and contraventions, and the principle of collegiality is set aside for certain offenses, allowing judgments to be made by a single judge. A labor court is also established within each Tribunal de Grande Instance (TGI).The text, composed of 115 articles divided into 10 chapters, underwent an in-depth examination by the Committee on General, Institutional Affairs and Human Rights (CAGIDH). For the CAGIDH, this rereading is expected to improve the accessibility of justice, accelerate the processing of legal cases, promote the use of national languages in proceedings, and strengthen credibility and trust between litigants and the justice system, while aligning the judicial system with national realities and expectations.According to the Minister of Justice, Edasso Rodrigue Bayala, these reforms aim to build a credible, accessible justice system that meets the deep aspirations of the Burkinabe people. The law will be promulgated in the coming days by the President of Faso before its entr y into force.
