The order establishing this file was signed, this Tuesday, August 27, 2024, by the President of the National Council for the Safeguarding of the Fatherland, Head of State, Brigadier General Abdourahamane Tiani, reports a press release from the presidency of which the ANP received a copyThis order stipulates that from now on, persons, groups of persons or entities involved in terrorist acts or in any other offences which undermine the strategic and/or fundamental interests of the Nation or which are likely to seriously disturb public peace and security will be listed.It also sets out the terms and conditions of registration and withdrawal as well as the related effects.This is an administrative procedure aimed at strengthening the mechanisms for combating terrorist acts or offences that undermine the strategic and/or fundamental interests of the Nation."The facts likely to give rise to registration in the file include, among others, the commission, planning, support or facilitation of terrorist acts; membership in a terrorist entity; threat to the stability of the nation; carrying weapons against the State; intelligence with a foreign power with a view to engaging it in hostilities against the State, by providing it with the means, by facilitating the penetration of foreign forces into Nigerien territory, by undermining the loyalty of the armies or in any other way; delivery to a foreign power or its agents, in any form and by any means whatsoever, of information, an object, a document or a process which must be kept secret in the interest of national defense; dissemination of data or remarks likely to disturb public order" specifies the order of the Head of State.To this end, "the registration of a person, a group of people or an entity in the file occurs as soon as an investigation or legal proceedings are opened; after a judicial conviction; at the request of the intelligence services" said General Abdourahamane Tiani.According to the press release reporting the Head of State, "this registration wi ll automatically result in the freezing of financial assets for the persons or entities concerned, a ban on traveling within the country and abroad, and restrictions on commercial transactions."In the event of prosecution, the press release also states, "for these offences, the individual prosecuted may be provisionally stripped of Nigerien nationality by decree and this stripping becomes definitive in the event of a sentence of imprisonment of five (5) years or more."Finally, a National File Committee is established to rule on requests for registration or withdrawal and on administrative disputes relating to the registration or withdrawal of persons, groups of persons or entities from the file.Source: Burkina Information Agency
